WHY YOU SHOULD ATTEND

Every source of data available indicates that the tsunami of foreclosures in Maryland and around the country will continue to increase in the next months and years. Ten thousand new cases in Maryland will be filed in just the coming weeks alone.

In the first quarter of 2008 foreclosure filings more than doubled in the United States, with almost 650,000 properties in some stage of foreclosure, or 1 in every 194 households (according to RealtyTrac, Inc.) This national figure is 112% above the figure for the first quarter of 2007. Payments continued to rise for subprime adjustable mortgages and home prices continued to fall, leaving property owners unable pay their mortgages and unable to sell or refinance their homes. To add to the distressing situation, the median U.S. home price is likely to drop a record 5.8% this year, according to Fannie Mae, and sales of existing homes will plunge to an 11-year low.

In Maryland, emergency legislation to help homeowners in foreclosure took effect on April 4, 2008, but not before first quarter statistics confirmed the deepening foreclosure crisis, as more than 11,000 homes were foreclosed on in the first part of the year. Now, roughly 1 in every 200 homes in Maryland is in some stage of foreclosure proceedings. While most of the foreclosures were initially concentrated in and around Baltimore City, the trend has expanded to Prince George’s, Montgomery and Baltimore Counties. Even in more rural counties such as Kent, Garrett and Somerset, foreclosure events nearly tripled in the fourth quarter of 2007. There is no part of the state of Maryland that has not been adversely affected by the negative consequences of foreclosure.

 

WHAT YOU WILL LEARN

 

This program will provide an overview of the new foreclosure law and practical, focused advice on how to effectively defend homeowners in foreclosure and how to assist homeowners in transitioning from a home they can no longer afford.

Maryland’s new emergency legislation has modified the foreclosure process to provide new protections to homeowners. The Real Property – Recordation of Instruments Securing Mortgage Loans and Foreclosure of Mortgages and Deeds of Trust on Residential Property bill lengthens the foreclosure process from as little as 15 days to approximately 150 days, giving homeowners a reasonable opportunity to cure a default and more notice before a foreclosure sale may occur.

In addition to learning about the legal defenses, procedural safeguards, new notice requirements and extended timetables under the law, you will hear how to spot and raise noncompliance issues under federal and state laws. You will hear about pending litigation to determine the validity of transactions involving questionable bona fide purchasers and bona fide lenders, as well as the ins and outs of the “Ohio standing defense.”

Experienced, knowledgeable consumer advocates will give you practical strategies and tools for thousands of Maryland clients who need legal assistance in the coming weeks, months, and years. You will hear how to effectively negotiate on behalf of borrowers for loss mitigation via workout, repayment plan, or loan modifications. You will also learn how your practice can do good to preserve sustainable homeownership while doing well.

THROUGH THE PRO BONO RESOURCE CENTER OF MARYLAND

MICPEL, Civil Justice Inc., and PBRC of Maryland have joined forces to provide a number of free scholarships and reduced fee registrations (awarded on a first-come, first-served basis) for volunteers who will agree to provide foreclosure defense representation and advice through PBRC and Civil Justice sponsored programs and activities.

For example, participating attorneys will be asked and expected to: volunteer at a Foreclosure Solutions Workshop for homeowners in distress; negotiate with the loan servicer on behalf of the homeowner to renegotiate loss mitigation or the borrower’s reinstatement; and/or represent a homeowner in defense to a foreclosure action.
