WHAT YOU WILL LEARN AND WHY YOU SHOULD ATTEND

A lawyer who collects debts on behalf of a client must successfully accomplish the collection of the account and must comply with a widening array of legal guidelines governing this field of practice. A collection case should result in recovery of money for the client in an efficient manner. Additionally, lawyers collecting consumer debts must comply with the Fair Debt Collection Practices Act (FDCPA). The FDCPA coverage has been extended to regulate lawyers engaged in litigation activities by the Supreme Court decision in Heintz v. Jenkins.

This program will explain how a lawyer should handle collection matters without wasting a lot of time, frustrating the client and/or exposing a lawyer to substantial fines and tortious claims. Designed for the attorney who handles collection as part of a general law practice, Debt Collection: The Profits and Regulatory Perils of Collecting Debts will focus on debt collection from its initial stages through suit and enforcement of judgment. The faculty will also discuss ethical considerations mandated by the Maryland Rules of Professional Conduct. Our outstanding faculty of practitioners experienced in debt collection will provide a practical perspective on the economics of collecting debts.
