Chapter 11 for Individuals
New Chapter 11 for individuals under BAPCPA is now somewhat similar to Chapter
13 but also differs from Chapter 13 in critical ways,
not only for the debtor but also for debtor’s counsel. The panel will discuss
how Chapter 11 for individuals works under the new law, who is a candidate for
Chapter 11, advantages and disadvantages of Chapter 11 for individuals (yes,
there can be some significant advantages), major differences from and
similarities to Chapter 13, debtor’s use of postpetition earnings, oversight by
the Office of the U.S. Trustee, involuntary Chapter 11, and last but not least,
payment of counsel fees in a Chapter 11 individual case.
