Why you should attend and what you will learn...

The standard preliminary issue in every case is the determination of which court has jurisdiction. Often, a case could be filed in more than one jurisdiction and venue based on a variety of factors, including domicile, place of business, or tortious conduct to name a few. Once a determination has been made as to where an action MAY be filed, the second and more important issue for the attorney is where an action SHOULD be filed either to maximize recovery for plaintiffs or minimize exposure for defendants. Our experienced faculty will address:

    ¨ How case value is influenced by jurisdiction and venue;
    ¨ How to ensure that you file your case in the correct jurisdiction;
    ¨ How to prevent plaintiffs from forum shopping;
    ¨ What can be done when the case has been filed in a jurisdiction which the
        defense recognizes will increase its exposure;
            a. Motion to Dismiss
            b. Motion to Transfer
            c. Removal to Federal Court
    ¨ How the jurisdiction and venue affect selection of an expert;
    ¨ How jury demographics should be considered in choosing or limiting the jurisdiction and/or venue in which a case is pursued.
